Arguing jurisdiction in a criminal case in New Jersey can be a difficult matter. Usually, it's accepted that the case would fall under the jurisdiction of the area where the crime was allegedly committed. Yet prosecutors have attempted to argue this point, often citing special circumstances which should allow the defendant's state of origin to try the case.
A recent case involving two Bergen County men has put the idea of jurisdiction to the test. The men are accused of having sexually assaulted three of the teenage girls for whom they had been serving as chaperones on a 2011 trip to Germany. Both men deny the accusations, and are both currently free on bail.
